Yes and no. It depends on the item and what you call it. Selling fake Prada and calling it Prada is definately illegal. Some item designs are copyrighted and some aren't. For example, selling reproduction cast iron toys & banks isn't illegal unless you claim it's an original and not a reproduction. The same goes for many antique glass items and a host of other products. Any use of a company's trade-marks or names, for items that are knock offs or counterfiets and without their permission, is most definately illegal. eBay does nothing to monitor the legality of sales themselves unless the item is reported by a user or a registered trade-mark owner (VERO). Even then they may not do anything about it. eBay claims to have no responsibility for what is listed. They only provide the venue.
The proliferation of reproductions in many antiques and collectibles catagories has created distrust and hurt the prices of the authentic items that are listed. The cast iron toy & bank markets have been devastated because of all the repro- junk from China. Women's clothing and accessories has also taken a large hit.
The bottom line is ask the seller questions and scrutinize their answers. Check out where the seller is from by clicking on their feedback number. Check their feedback too. Don't buy ANYTHING from China. Always suspect any item with a low starting price and high shipping cost. Pay with a credit card or US Postal money order whenever possible. If you get ripped off or buy mis-represented goods you have some recourse through your credit card company. Also, the U.S.P.S. Postal Inspectors don't take kindly to the use of the U.S. Mail for thievery and fraud.

Many people does it but it is not legal.. and why to do it when there are so many stuff to sell it. Ebay.. the name spell success. It is a big business having multi billions dollars of tranaction happening in a year. There are countless person having a earning of 6 figure income. And of course many others having a regular income varying netween $500-$5000 per month. There are many persons, who has taken up this as a career but dropped it because they did not feel as an opportunity due to some or the other reason. eBay's stance is that it is simply a marketplace for sellers and buyers, and it is up to the copyright holders to monitor their brands and check for counterfeits. eBay has basically adopted a "hands off" approach to counterfeits.

What eBay has is what they call VERO Program or the Verified Rights Owners Program http://pages.ebay.com/help/tp/vero-rights-owner.html where the trademark or copyright owner can monitor eBay listings and request for immediate removal of listings that promote counterfeit products. Some of the big brands such as Kate Spade bags or Gucci are very active in the VERO program and prowl the sites frequently and closes those auctions selling counterfeit products.
But it has to be the VERO member who needs to check on the listings. Some trademark/intellectual property owners do not actively check eBay auctions for counterfeit versions of their products, and sellers selling those items are able to get away with counterfeit. But if the VERO member is active, the listing will be closed immediately without refunding the seller of the fees paid; and if repeat offence the seller can be kicked out from eBay

That is 100% illegal. People could just reproduce millions of the original item and make huge profits if it wasn't. You should definitely report the sellers.
