No. If your ex husband is the childs father surely he should have some visiting rights you don't say where you want to emmigrate to,would it make it impossible to see the child.

I'm going through the same thing. I want to move to USA to join my American husband and there's no way my ex will sign to let my kids go with me. They don't even see their father. I've spoke to my solicitor who has said that I'd have to take him to court and if we can prove that my kids can have a better life in the USA then there shouldn't be a problem. I can see it being a long process though. My daughter is 16 in 12 months so she won't need his permission but my son of 12 will. Good luck

if yo have sole custody, physical and legal, yes. you do not need you ex's permission... however, depending on the country you are going to, the immigration of that country mightr ask you to get a written agreement from the other parent.
actually, evern airlines may ask you to have a judge's permission or other parent's permission to let you embark.
with the divorce decree on hand stating you have full sole custody, you may be able to overcome all or some of the difficulties...
if you do NOT have full custody, it is kidnapping.

Think you need to give us a little more info.

If your ex-husband is a good father and has regular contact with your children then it wouldn't be fair of you to take them away to another country without his consent. You wouldn't like it if your children were taken away from you.

HOWEVER, if your ex-husband doesn't have regular contact with his children, then I don't think it would be very fair of him to stop you taking them...

I think the way our government judges cases such as this is very unfair, they generalise all cases instead of taking things on a case by case basis. It's all sooooooo wrong...

I wouldnt let my wife take my kids away abroad either. How would you feel nowing you couldnt see your kids? Just because you carried them doesnt mean your the only parent who loves them. Nobody has the right to stop someone seeing thier kids so long as they are a good parent. Would you give him custody and emigrate knowing you couldnt see them, No you wouldnt.

I have gone to the same thing a year ago
1st if you have sole custody if your child it does not matter
but if you share custody yes you need to inform him and hope that he does not give you a headache

I believe you can if you have full custody of your child and your husband hasn't applied to the court for visitation.

unfortunatly if you do not have consent from ur ex and leave the country... if he reports you, it is considered kidnap...
i am going thru the same thing... i want to go and live with my fiance in turkey and have found a good school for my daughter.. but i cant go because my ex wont give his consent :(

you could but why would you want to, is he a bad father ? is he abusing his child. and what if he gets a court order and makes the child return to ware he is, just tell him what you are thinking about, talk about it seriously. ask your child what it would mean to them never to see daddy again they have the right.and what about their gran parents, there's a lot to be considered.
