The problem is his friends and their ages, I'm surprised you haven't guessed this by now. Wait until they start drinking and he's still underage.
You can talk to him, you can set an example but that's about it. Your parents should know, whether you think they should or not, they are the parents. They are the responsible parties. If someone goes to jail, they will so, they should be informed.

If no one else is going to take responsibility, then it looks like you will have to. Find some "shock tactic" images of the consequences of smoking- you won't have any problems finding them. Tell an adult that you trust and who will have a good influence on him. What concerns me is how a 12 yearold managed to get alcohol and cigarettes in the first place- surely no respectable establishment would risk their business by selling these items to someone who is quite obviously a minor. Find out where he is getting it from and try to eliminate that source- if he is getting them from an older relative or friend, make sure that he is not alone with them if you can prevent it, and if you witness them supplying your brother, tell them that if you see it again, or find him with these items again, you will turn them in for supplying a minor.

Try to see the big picture. Talk to him, but if it doesn't work, know you tried. Not telling parents may earn you the trust that you both will need, he may need the closeness and trust of a confidante which is far more valuable. If he has friends who are a bad influence, the horse may have left the barn. Be there w/ hope and love. Thank God its cigarettes.

I'd sit him down alone and have an honest, serious conversation with him. Let him know what it will do to him if he continues. Ask him why he does it. There's never a good answer for it. Gain trust in him and let him know you aren't telling your parents. It's just between you two. However, if he doesn't quit, you're telling his parents so he can get some serious help for it. Sometimes they need a scare when they are acting like they don't care.

Tell him that smoking is nothing cool. If that doesn't work, take him to the nearest graveyard and tell him that's where he could be in 10 years. There's nothing wrong with scaring a kid into doing the right thing.

for one he shouldn't be hanging with kids older than him and yeah you need to tell if something else happens and its worst than smokes then you will feel bad keep him on the right track it is so easy to influence a child at that age i have a son which is 11 your brother he needs to be watched better help him out before its to late and it sounds like if these boys are smoking they are probally doing worse

when yo get a chance talk to him one on one and let him knwo that you saw him smoking and tell him he needs to stop and if he need s your help you will help him.but if he doest try and stop that you will let your parents know about his smoking and that he is hanging with guys 3 and 4 years older than him.

talk to him privately (to avoid embarassment from friends) tell him if you see him with a cigarette again you'll tell (or something to make him aware that you know his secret)
if he is open enough to listen more, tell him about the bad things he'll get from smoking etc.
