First I need to know is was the person awakened by the attack? Another question is are they married? There are various rape charges that can be presented to a jury and the court will ask for specifics.
I've listed the types of rape according to law enforcement and they are:
TYPES OF RAPE:
Forced Rape: Sexual intercourse carried out against a person’s will by the use or threat of physical force is sometimes referred to as forcible rape.
Date Rape/Acquaintance Rape: When a person rapes a person he or she knows. The 2 people may be friends, former lovers, or presently dating. Sadly, studies point toward a woman is more likely to be raped by someone she knows (“friend”, relative or acquaintance). The term acquaintance rape is usually applied when the sexual intercourse is nonconsensual but does not involve the physical coercion typically associated with forcible rape, such as assault or threats of violence.
Marital Rape: Unwilling sexual intercourse of a person's spouse. So if the woman was awakened by unwanted intercourse, this would be the charge.
Statutory Rape: Sexual intercourse with a person who has not reached the age of consent is known as statutory rape. The age of consent for sexual intercourse varies state to state. Under most state laws, the younger the victim is, the greater the punishment.
Rape of Males: It is possible, although unlikely, for a woman to be charged with raping a man. Most common rape to man or boy is done by a male which is forced oral sex or sodomy.
Being raped while sleeping, is not, in the view of a jury deminished capactiy. Deminished capacity is if the woman/man is not of stable adult mind; ie. mentally retarded, alzhiemers or on any heavy dose of meds that will not enable that person to defend themself.

Yes it is rape. A woman MUST be conscious during the actual sex act or else it is illegal EVEN if she gave her consent and then passed out in the middle of the sex act.

There are certain ingredients that make an act a rape under law: those ingredients decide if it is rape or not!

If you mean having sex with someone while they are sleeping, yes that is rape. If someone is asleep, they can't give consent. Sex without consent is rape.

The question pretty much answers itself.... Sex has to be consensual from both parties, if you're asleep you can't give your consent now can you?
