Everyone seems to ask this question but I've heard there is a different age to actually legally purchase cigarettes (18) and legally able to smoke (16). I'm not sure this is true though? I live in Chicago and it seems that the police don't care about teens smoking, I mean teens smoke right in front of the school and in front of police bikers! I have seen a police man search a kid for smoking but when he wrote the ticket, it was for littering, not acutually smoking, and he's 16. So i just wanted to know if the legal smoking age was 16?

most states it 18 to legally buy cigarettes, as for smoking them depends on the police officer some won't do anything but others will with people under the age limit to smoke in their states

States are responsible for their smoking ages. No state in the US currently has an age below 18, however, most states provide that parents or guardians can supply ciggarettes for free to their children/wards. This causes issues for law enforcement because they would have to check with every parent of every child below the age of 18 to see if they were given to them. Right now, with most places having shortages on law enforcement, this just is not feasable or so they say.

the legal age to buy and smoke is 18. But kids who look 18 or close to 18 but the cops wont do anything most of the time.

Most states it is 18. But take a piece of advice from someone who smoked for 49 years and now suffers with severe Asthma and COPD so bad I am now totally disabled and have been since age 51. DON'T SMOKE. Do yourself a favor.

It really depends. Where I live you have to be 18 to smoke but 21 to buy ciggarettes. You must show proof that you are over 21..... around here, they let teens smoke too as long as no one really see's them. If pepole call in and complain they will go to jail.

Legal age for smoking is 18....Police don't tend to push the issue....mostly because they would be writing tickets all day for minors smoking tobacco....they have bigger fish to fry!!!

I allways thought the government has a rule that every state couln't have it lower tan 16, but in most states it's 18 anyway.

BUT, I don't know, thats just what I thought.

Different states have different laws. However, according to Federal Law a person must be 19 years of age to purchase, and to use tobacco products. Some states, such as Georgia, have different standards.

I believe it is 18 everywhere...it is in Oregon
