a person has paid money to a telemarketere for a product that was promised but was never received. the caller said the product was high quality and that the compnay was a non profit organization to benefit disabled veterans.

what would be the appropriate legal remedy to this dispute and why?

Sounds like ya got scamed. Report them to the Better business bureau.

It may not be a scam. The first thing you should do is to contact the telemarketing company. May be it has not been shipped because they do not have enough stock. May be it was shipped but was tied up in the post office. May be it was lost on transit.

You must contact the supplier and see what happen. Give them a chance to explain it. There are many legitimate telemarketing company in this country. They are willing to keep their customers happy.

If you really find out it was a scam, you can file a complaint to the Government's Consumers Services Department or BBB. The last thing you should do is to file a claim in the Small Claims Court.

Another thing you should know is most of this telemarketing companies do not keep the supplies. Quite often their orders are drop shipped by the manufacturer or wholesalers.
