ok...the plantiff was driving his vehicle in a nnorthernly direction when the defendant ran a stop sign going east and he did severe damage to the plantiff's vehicle, including personal injuries to the plantiff.

what would be the appropriate legal remedy to this dispute and why?

Basically the defendant should pay car repair, medical costs, and pain & suffering (if any).

The plantiff should sue the defendant for damages, medical payments and pain and suffering.

Call your insurance company. That's what they do. Then call a personal injury lawyer. That's what THEY do! And apparently they do it well! But first, research the lawyers' wins and losses. It's always good to know what you're getting.
