This ditch was built without an easement and the easement was obtained after. All the neighbors have signed but I havent. What can I do? It looks really bad and will cause MORE flooding problems. All of my neighbors also agree with me, but if they speak their mind to the city, they will not get their street plowed in the winter. What do i do!

The city has the right to emanate domain, but they should have paid the people for the land they took at a fair market value. An easement I believe is only for putting in utilities and after they have been put in the land is restored to its original condition. Get a lawyer and see if you can sue the city for taking your land the way they did. First consults are usually free. Then if you want to go further you may have to pay a retainer fee.

It's difficult to believe that complaining to the city will result in the city withholding services from your neighborhood.

Of course, if you DO complain, and they DO withhold plowing services, you can sue.

In the meantime, it's important to understand that a municipality generally won't make groundwater flow accommodations without being on firm legal footing. If you feel that the ditch was constructed illegally, you'd do well to become familiar with both the local and state codes related to this sort of construction.

If you still feel, after researching the matter, that the city acted illegally, you can involve the courts to get the ditch removed.

What do you want to do? Do you want the ditch filled in, dug deeper, or dug somewhere else?

If the easement has already been granted it doesn't make any difference if it was granted before or after the ditch was built.

Just prepare to sandbag your yard in the spring.

Your best choice may be to re-route the ditch around your patio. The amount of open channel flow in a ditch will usually means the pipe has to be quite large.

ask for a safety fence.
speak to city officials and remind them that your vote elected them and your vote can also remove them.
contact a attorney. if they didn't get proper easements from all, they are in violation of your rights.

Look at it this way .. it's better than some really bad neighbor moving in who stores tons and tons of junk in his yard.
