uhm. i dont exactly consider it...but id need more info to really deteremine...hes prob barely begining puberty, and means no harm by it...id sugest the girl or her mother/friend/sister/etc talk to the boy if it bothers her before bringing authorities into it. and talking to the boy's parents would be good too.

I would have to ask myself, was the boy being playful, or is very old mentally and emotionally for his age.
I can also tell you as an adult & mother of a 9 year old boy, that sexually harrassment is an adult conspection and normal 9 year old boys would not even think of pinching a girls butt in anything but play or "getting back" at the girl for something!

According to the law it is sexual harrassment and you can get the authorities involved if you would like.
To me personally, I think it's just kids being kids, but I don't know if I would feel the same way if I had my own kids and it was happening to my little girl.

No. By most state statutes, this would not be considered sexual harassment. On a moral plane, it is no more than bad behavior because a 9 yo. cannot know how this would impact an age-mate other than it is annoying her. I really doubt the INTENT is to cop a cheap feel.

harrassment applies to any students at any age & at every level of education. some factors include
kissing on the cheek, pinching someone's butt, or even plain holding hands w/o consent can already be called harrassment...

i personaly think at 9 it's prob just kids being kids. but at this day in age that kind of thing can be harassment
