You can sue for literally ANYTHING. Attorneys will take your case based on a large percentage of the money won (30- 40%?) . Here are some things to consider: - Was it your son's fault? Was he goofing off or reckless? Were you watching him? You've already stated you don't know what happened and that shows you weren't supervising him. Kohl's WILL have video of this- all department stores videotape every inch of their floorspace and keep it for at least a year. I gaurantee the manager pulled the tape of your son's fall and submitted it to corporate with a full incident report exactly in case you do decide to take legal action. - Was Kohl's reckless? A display just sitting there is not reckless. A reasonable person would go around it. If it's been there for weeks without incident, then I wouldn't consider the display to be dangerous as literally several thousand people went around it without a problem. Now, if an employee was cleaning under it and shoved it into the asile without a sign or cones, etc. then they might be considered reckless. -Accidents happen. As a father of three and a former kid myself, I can tell you that even with the most careful supervision, kids still crash into things and it's no one's fault. To conclude, you can sue and have the right to consult an attorney, but consider your actions too and determine if just because your son fell does that constitute negligence on Kohl's part or simply a childhood Ooops that left him with a scar?
