Malum in se is Latin for bad in itself, as opposed to malum prohibitum, bad because the law prohibits it. So there is a value judgment. Simple assault is often a misdemeanor, that would likely be malum in se to anyone. Driving under the influence is often a misdemeanor, that is also likely malum in se. Trespassing, public nudity, public drunkeness are often violations or low level misdemeanors. Are they malum in se or malum prohibitum? Less than an ounce of marijuana, probably only malum prohibitum. Hope that helped.

Trespassing, speeding, public nudity, public drunkenness, parking violations, copyright infringement, driving with a broken taillight or headlight, leaving the scene of an active accident, and doing licensed things without a valid respective license are malum prohibitum. Murder, manslaughter, shoplifting, burglary, breaking and entering, driving under the influence, jaywalking, texting while driving, fraud, forgery, counterfeiting, arson, grand theft auto, embezzlement, and treason are malum in se. Vague offenses like domestic violence and sexual harassment are malum in se if they are by narrow definition, but malum prohibitum otherwise.
