The plaintiff is also claiming punitive damages, outrageous medical bills, I already have 12,000 in restitution order, the civil lawsuit says $175.000 included the 12,000 which is a double jeopardy. How can bankrupcty help if the judgement hasn't been ordered yet? Or can the punitive damages be cleared for the DUI?
if i im already paying 12,000 in criminal court?

Bankruptcy will probably not clear you of this....depending on what chapter that will be used. Sounds like you need to get a better lawyer......hopefully if you had insurance, they'll pay.....that way if the insurance refuses to pay they can sue them. In the mean time......you need to get everything out of your name.......or they can take it in lieu of the judgment. You can transfer it to one of your children or a family member. You've learned a hard lesson, so don't do it again. If you do, then you just may get prison time. Best of luck to you.

Bankruptcy WILL NOT discharge court ordered judgments. I hope you have a really good job, because it sounds like you got drunk, wrecked and hurt someone. DO THE CRIME, PAY THE DIME!
