My daughters father has never been around. Plain and simple...we haven't hid from him...i haven't kept him from seeing her....he just isn't interested! we have had a wonderful man in her life for the past five years so she isn't out anything. anyways... he hasn't mad a single attempt for at least two years, not a phone call, nothing. can i file for child abandonment to get his name of her birth certificate? i don't want his money for child support so that's not an issue. how does that work? will it cost a great deal in legal fees? where would i even start?

Tell him that you will file for child support unless he is willing to let the new man in your life adopt your child.
I know you said you don't want money from the man but if he is as bad as you say, and you make the threat look serious enough he will be likely to give up custody.

I was adopted by my step father when my father could no longer afford child support.

If you file for child abandonment it may cost alot in court fees. My aunt went through the same thing when she had my cousin. Instead when she married her new husband he adopted my cousin. This puts him in partial custody with you and takes the responsibility away from the "real" father. You should call a lawyer and ask for a free consultation and see what they tell you.

I would say that you can safley do it now... Do you know where he is and you really need to get a good attorney for this matter and take him to court to get this taken care of... He will need to sign over all rights to your daughter... I know and feel for what you are going through as i have a daughter whos father wants nothing to do with her and i have no idea where he is at but I am happily married and she has a daddy who loves her very much and has raised and cared for her since she has been 2 months of age..... I am not sure how it all works but i wish you the best.

you can' t get his name off the birth cert. and you shouldn't anyway. depending on what state your in you should be able to have him stripped of his rights by now. the man in your life should also be able to start to make her his child, some states require a new man to step up before they will remove rights of the father.

The only thing you can do is to get him to give up his parental rights. Thats the only way. Filing child abandonment wont do it.

You can't change the fact. Even if your new hus. is more of a father to her, why would you want to change her birth cert.? He's her bio. dad, like it or not. You picked him.
