if that is the total amount of his bail. (not 10% for a bondsman). When he gets sentenced and appears he will recieve the bond back. Some states require that the bond be in his name only so they can take any charges,restitution,etc. out of it before returning it. So, Yes, but prepare to have it taxed if it is to be posted in "his name only".

You'll get your money back once the case is discharged. It doesn't matter if he's found guilty or not, once the case is completed, you get your bail money back. It's only purpose is to guarantee his appearance in court.

I believe you only lose the money if your brother goes mysteriously missing before his court date.
