Get it sold and take the proceeds. If you want the house and want him off of the mortgage, have him sign (and record) a Quit Claim Deed putting only your name on it. Otherwise, you are screwed. YOU CAN'T MAKE ANYONE DO ANYTHING. You can suggest. You can plead. You can make it sound like it is his idea to pay it.

Talk to a lawyer and see what your options are ... If you have the mortgage and house now you might want to get the house in your name and you will have to make the payments or the bank might forclose on the house.

Why should he be paying your mortgage? If you have children and its all been sorted by the court,get in touch with them or the building society and explain it all to them otherwise maybe you should pay it yourself!

if he is ordered to pay it, I suggest u pay it then take him to court for a default on a judgment order.Or u can also file it under a show cause judgment.But make sure you pay it so u don't lose the house. The courts will order him to reimburse u, or he can go to jail

If he is supposed to be paying it, and he's not, then they possibly could foreclose on your house before long. If they foreclose, you will have to move at some point and vacate the house. Good Luck! I HOPE he IS making those payments!!

Pay it until the property is split if he is going beyond the period that it will be repossessed if you can afford to. Divorce is messy.
