Okay so my son's father gave me his laptop as mothers day gift last year because my computer was (and still is by the way) falling apart. After a bitter break up he decideds he is taking it back out of anger. He has since sent me an email saying how sorry he was for taking it, and that he wanted to give it back if I still wanted it and mentioned that it was a gift for mothers day and now would be giving it to me again now as a christmas gift. Long story short he never gave it back. It was my understanding that if you give someone a gift by law you are not entitled to it back. I am thinking of going to court to get it back but I just want to make sure I am not wrong before I make an @ss of myself.

I think this was an espisode of Judge Marilyn Milian - Peoples Court. I'm trying to remember what the outcome was.

In a case like this it usually comes out to proof. Can he prove that its his computer, he bought it and therefore he owns it? Can you prove its your computer? That it was a gift to you?

Well it all boils down to proof. What can you prove?

BTW: Unless he breaks into your house and takes it back, how can he get it unless you give it to him? Simply say no - see if he sues you over it.

I think you should let some things go. They will drive you nuts and cause unneccesary bad feelings down the road. Just do not take big ticketed items from him again

I think it would make more sense to just move on and forget about the laptop. Don't let him know that he has anything that you want or need.
