New World Communications of Tampa, Inc., a subsidiary of Fox News versus Jane Akre.
Akre originally won the claim that she was fired in retaliation for threaten to disclose the truth regarding the BGH story (growth hormone for dairy cattle). She argued that the firing was against a law, rule, or regulation, a requirement for the "whistle-blower statute".
However, the court of appeals argued that no such law, rule, or regulation existed. There is an FCC policy against lying but that is not an adopted rule.
"Because the FCC’s news distortion policy is not a “law, rule, or regulation” under section 448.102, Akre has failed to state a claim under the whistle-blower's statute. Accordingly, we reverse the judgment in her favor and remand for entry of a judgment in favor of WTVT."
The bottom line is that there is no law, rule, or regulation preventing news media from lying, which is why she couldn't win under the "whistle-blower" statute.

Fox News is still the best station on getting the truth out and keep the people politically informed about the issues that other stations will not mention. I say no guts no glory. Obama's lawyers and staff are working over time to make it bad for them. This the "change" we need in freedom of press in every way. The truth must come out and people must speak out more on what is going on in our government. The words in journalism is who, what, when, where, why and how and it would be wise that all news stations and newspapers put these words to work in reporting.
