You turn into a pumpkin. Then you have to file a form P-1043. By Thanksgiving you must file a pie exemption to keep from being eaten.

Of course the filing due date for you is April 15th, and you can get an extension if your W-2 is still late by then. If necessary, you are allowed to file a substitute W-2. If you report your employer for going past 4/15, the IRS will come down hard on them. Between Feb 15 and April 15, you may be able to get the IRS to give your employer a phone call. You have to try asking for the W-2 first. That's your call.

Hopefully you have changed your address (if you moved) with all places in which you worked. It is not their fault if they have the wrong address.

There is a law that says employers must send out W2s in time for the employees to receive them by Jan. 31. If you don't get yours, first give them a call, before getting all "legal" about it.

The IRS recommends you contact your employer between Feb 1 and Feb 15. If you haven't received it by the 15th, send in your tax forms with a note attached. This will prevent you from being liable for incorrect tax forms.

(You can get all the information you need from your other paperwork, like your final pay for last year and a statement from your 401k account if you have one.)

Yell at your employer. What can you do? I guess legally you could try to sue him or report him to the IRS but that would not make you receive your W2 any sooner.

I think an employer has till the middle of Feb. to get your W2s to you.

If you have not received your W-2 in the mail automatically, you should contact your employer(s) and inform them of such, requesting that they send you one. You do not need to prepare your tax return until April 15, but you should have your W-2's well in advance of that in order to have time to do the return.

Companies are only required to have them post marked by Jan.31. If you don't receive them by the second week of Feb. then I would start making phones calls to see where they could be.

Contact the company who's supposed to be sending them to you and find out the delay. Sometimes it's just the mail. Give it a week after checking with them, then I would check with a CPA on what to do.
