My little sister was in Wegmans one day with a friend and my daughter. Her friend stole something and my sister being an accomplice ended up with an endangering the welfare of a child charge. This was almost a year ago, but she's still going through court. She was never convicted of anything and is getting the charges dropped. I told her that it shouldn't show up to the daycare she just applied for because she was never convicted and she hasn't even finished going through court. What do you guys think?

Yes. In doing backgrounds for my state, I frequently come across information that was dimissed, or shows that there is still a court determination pending.

Everything from violations, misdemeanors, diversions, felonies, and anything in between has shown up.

It will not show up as of yet but really, if she is going to work with children and is in court for an endangering charge, they can find that out. They do checks and if she lies on the application, that is another crime and not only will they fire her but they can press charges. I would tell her to be up front with them, because they will find out eventually.

I was investigated by CPS 4 times for abuse.. Each time was found untrue.. The last time CPS came by they said "we see where u have been investigated before...it's on ur record"... Once it's found untrue, it should be taken off but it's not and never will be.. I was found guilty for medical neglect (long story and I was innocent).. The day I was to go to court, my attorney told me that CPS had closed the case due to insufficient evidence.. It's still on my record as being found guilty.. They will find out about the charge EVENTUALLY...it will be on her record..even if she's innocent

If the case is not complete it shouldn't show up and if she is not convicted it won't show up. Legally the only thing that can appear are Felony Convictions.
