We have another child together and have been in a defacto. relationship 4months before the first child was born.
The biological father is not on the birth certificate, I do not receive child support. I have no dna test to prove who the father is, do i still need consent. What does my partner need to do to adopt him.

have some more details. something could happen before i decided i was the marrying type. I just dont want to lose my son and have my partner lose him aswell. If i died all of a sudden or something, then i want to know my son is with someone who loves him as much am i do, well nearly :)

You must file at the court. Go online for your area and find out which courthouse houses the "family division." You can do this pro se without a lawyer. The forms will have instructions on what is needed. one thing is to give notice to anyone who may object. So, you may ahve to contact your ex or whoever you think the father might be. Nevertheless, once you ahve done what is required, a judge will grant the adoption. Once adopted, your son will legally also be your current partner's son and each will be entitled to rights and obligations arising therefrom. Though your facts don't allude to this, I thought there was enough ambivalence in your quesiton to point out, most states do not allow same sex couples to adopt under any circumstances. yes you have to find the biological father first for the state.If youve tried for at least six months(depends on state regulations) to contact or test the real father with no success, then by law he can adopt your baby.It will go faster if you go to court and say he takes care of both kids without a problem, you will win. The state just has rights for the real father assuming he knows, to give up custody.if he comes back one day and tries to see the baby with new adoption he wont have a right.If the baby is not adopted yet he can say no and try to get custody..BE CAREFUL..good luck!!

I think the laws very from state to state. Go to your state or city home page and there has to be a link somewhere about adoption and domestic partnership. I have a friend and I don't know how she did it. But that's in California. You may still have to send documentation to the father as a sincere attempt to inform him so years later he can't come back and fight for custody and other parental rights. Hope this helps.

as long nobody is named the father in the Birthcertificate then your partner can adopt your child with no problems .
Check with your family lawyer on this to take the proper steps !

That depends on the state you live in - if I knew what state you were in I could give you more information. I would suggest you consult a lawyer in your state who is knowledgeable in adoption law.

If you get married, that would be the best place to start. It would make the adoption process easier, I would think.
