If your loan is in Default status they will take your refund and apply it to the amount you owe and will keep doing do if you dont pay it before the next tax season. Belive me. I had a very small defaulted student loan and it happened to me and my husband.

There's a big chance that they will take your tax refund if you're not paying them. I have a friend that has student loan and she just missed 2 or 3 months paying them. The student loan people automatically have taken her GST credit cheque that she usually receives quarterly. My friend called the student loan made some arrangements to make sure that they won't take her tax refund. I would suggest that you get some advices to someone who have more knowlodgeable with this matter and also visit a student loan webstie http://osap.gov.on.ca/eng/not_secure/repay.htm to get some info before you contact student loan people. Very likely, unless your husband files an injured spouse form to get his share back, which would probably be most or all of the refund.

If they take the refund, then part of your debt would be paid off, and interest would stop accumulating on the part that's paid.

I dont know about them taking out "Student Loans" at all !!! I've never heard of that, in all my 44 years!!! Now, back "Child-Support", and oweing the "IRS" YES, I have heard of those two only......They check to see if you owe back child support or the IRS before you even get your check and if not, than they send you the difference!! Oh, also people who have had bad credit with house, or aptartment rental's....And left it damaged , and gave up their social security #, and got served also will have it taken out of their check's... And possibly their taxes, but I'm not real sure about it being taken out of their taxes..... I once knew someone who was complaining about that happening to her .... It was being taken out of her check though...... But, I've never heard of it being taken out for Student loans..... So, you may just want to call H&R block to find out.... Remain anonymous, and say your checking for a friend, while she's at work, you wont have to give any social security numbers or anything , for just a question...... so, give them a call, so you can rest easy, you know... good luck to you & your's!!!
