There is no lease. And the tenants are not paying for anything. When we moved in they let there lease run out. Now the only reasion i ask is because while we are thinking it may be a posability, if some things do not chage. We are simply woundering. And you can not judge me without knowing the entire situation. I have my reasions and that is all anyone needs to know. Please Do not judge me. If you knew the situation you yourself would probly wounder the same thing.

Your question isn't specific enough. However, tenants usually refers to people renting/leasing. If they have a signed lease then you can't just have them move out without paying them. If you breach their contract you will be liable for their expenses in moving out as well as the difference in rent they pay, for the term of the lease you had, if their new rent is higher than what they paid. (for example, 1 year lease @ $1000/m - you kickem out at 6 months, their new lease is 1 year @1100/m - you will owe them $100 for 6 months to cover the difference between the rent now and the rent with you.)
If the written lease has expired, but you verbally agreed to another lease (1 year for example) to be paid monthly, then the law says you don't have a one year lease - you have instead a month to month tenancy which can be cancelled at the election of either party as long as 30 days notice from the date of the next payment is given. (If you pay the first of the month, then you must tell them 30 days before the 1st of the month. Ok?

If they are on a lease, you can refuse to renew it when it runs out. If they are on a month-to-month tenancy, you can give them a month's notice. If they fail to pay the rent, you can apply for an eviction notice, which is normally posted for 30 days.

Sounds like you have some very caring tenants if they let you move into THEIR home! And you're thinking of putting them on the street? What kind of scum landlord are you anyway??

FYI, if you moved in with them, they can have YOU removed -- not you remove them!

You didn't say where you live, what jurisdiction.

You can legally give tenants notice for "own use" and have them leave in most places to allow you to move in.

Why did you move in WITH them?
