I have to go back to court for a DUI. I've been in jail for something totally different and am trying to get things sorted out again with getting a job, family etc. I don't think I have a drink problem but would it help to sign up to AA or something like that so the judge might see I'm trying to do something positive and give me a chance?

i hope new york has voluntary programs including AA. yes to your question,but make sure you are sincere about it and not just doing it to avoid punishment. it is the difference between failure and sucess.

Your first DUI, they SHOULD let you get off with probation, and those will probably be the most expensive drinks you've ever had.

Unless you were still on probation for the first offense, in which case you MIGHT to back to jail. And of course if you were found with any drugs or a gun, they'll definately take that into consideration, too. Also some jurisdictions have a 'scaled' system in which the 'higher you blow', the more time you'll get and more money you pay. All depends on the area.

Right now you just need to play it really cool, round up the money, you have a lawyer that you obtained, right? You can go to AA but don't go for the court, go for yourself. They don't charge money, and they don't give a receipt. And the judge definately won't care where you've been.

You'll probably be given active probation for a number of months, lose your license for 90-180 days, charged fine(s), which can easily reach a thousand or so, and be required to attend a number of MADD meetings, at your expense. Maybe pretty colored license plates for a year, or 'hotel jail' which they're starting to get rid of...

I feel for you, I've gotten into some 'mixers' in my life, and I'm just starting to realize that I can't drink anymore, not even a drop.

It depends on your state. In my state, DWI is not a criminal charge, so anything else on my rap sheet wouldn't matter. I could be a convicted murderer, and the state doesn't care - all it is interested in is the DWI charge.

You could go to AA, but do it to get help. If you are convicted of DWI, the judge has little leeway because he is compelled by law to give you the penalty, even if it's the minimum allowed by law. So going to a recovery program, while a good thing, has no effect on the outcome of your case. There is a mandatory minimum which must be imposed.

Again, I am speaking for the laws in my state - your state may have different DWI laws.

But do remember that you are still innocent until proven guilty. People seem to have this idea that if you get a DWI, you're automatically screwed. That's not so - all the laws regarding due process are still in effect and they are there to protect you from wrongful conviction.

Yes, duh Go to AA even try an inpatient treatment center. If you are in jail now, I will bet it had somthing to do with drugs or alcohol. If not, than my bad. Now you say you don't THINKK you have a problem. Well my definition of an alcoholic is someone whoes drinking interfears with their life.. Example: you going to jail. Making the decision to drive drunk is also a sing of alcoholisim... Getting the job is a good start, going to AA 9is a must, even if you arn't a drunk they can teach you a way of living that you may have never experienced before.. Trust me. I have spent a few years in the can myself. Allthoug I do not attend AA meetings on a regular basis it has been ten years since I have had a drink and over 15 since I have spent any time in a prison..

I would not hurt But some DUI charges carry a mandatory minimum amount of jail time The judge can not do anything about that expect give you the minimum amount allowed

I hope you go to jail you jerk! You have a problem; you drive a car when you are slosshed and have no regard for yourself and others around you. Why go to a program when those people are there for a real reason and you just want to look good? Trust me, the judge will see through you and throw the book at you. What a waste you are.

I have an idea. How about you don't drink and drive. If you don't do that, then you can't go to jail for DUI.

When I was a kid I learned that crime doesn't pay. If you don't want to do the time, don't do the crime. You knew damn well drunk driving is wrong, so f* you for trying to get out of the punishment. Be a man accept your punishment and if you're worth a damn, learn from it, and be something other than a pain in society's ***.

Grow up. I think you're full of it. You haven't expressed any remorse at all. You're thinking only of yourself. GROW UP!!!

Yes, Sign up to any help you can get. The more extreme, the better. You need to show the judge you are serious.
BTW, most people that have drinking problems, don't think they have a drinking problem, that's why they call it a problem... :)

if you sign up for AA the judge might think you are trying to get on the rite track
