If you have permission from the copyright holder of if the file is in the public domain, it's perfectly legal. If you don't and are unlucky enough, your chances of being caught are 100%.

Disclaimer: I am not an attorney. If you're looking for information that you can use as a legal defense, contact an attorney.

The legality of downloading or sharing any file on the internet "usually" depends upon the copyright and license status of the file contents rather than the method of distribution. If the creator of the content makes money by selling the it, then the odds are that it is illegal to share (or download) that file without the copyright owner's permission.

Therefore, if you write a poem and distribute it via torrent, it is perfectly legal because you own the copyrights. If, however, you purchase a music CD at the store, rip it to mp3 files and share the mp3 files, you are breaking the law unless you have written permission from the whomever owns the copyrights to the original music CD.

It's illegal to download period, but yes, to seed is illegal as well, unless the file is originally free like Linux/Ubuntu or something like that. Other material, which you would normally pay for, is illegal if downloaded OR seeded.

As far as I know, torrent it self is legal. So the illegal part is when you share or download copyrighted file without permission of copyright holder

if your downloading and seeding files that are not under copyright law, it is perfectly legal, but if you are downloading things that are under the copyright law such as music, movies or apps, it is very illegal. probably what you are downloading are under copyright law so yes downloading torrent files are illegal. it is very hard to get caught though.

Depends on what you're getting and where you are. National laws apply. Strangely, there is hardly any international law for the WWW yet.

addendum: who said this is a bad answer? Ugh, it's 100% true.

it depends on what you are downloading - unless you have the copywrite holders permission, or it is copywrite free, then no it is not legal
