If the cops had responded to the 2 911 calls when the boy was fisrt taken do you think this would have been considered kidnapping?

Yes, A person commits the crime of kidnapping if he or she unlawfully removes another without his or her consent from the place where he or she is found or unlawfully confines another without his or her consent for a substantial period, for the purpose of

(1) Holding that person for ransom or reward, or for any other act to be performed or not performed for the return or release of that person; or

(2) Using the person as a shield or as a hostage; or

(3) Interfering with the performance of any governmental or political function; or

(4) Facilitating the commission of any felony or flight thereafter; or

(5) Inflicting physical injury on or terrorizing the victim or another.

I watched the story on A&E and yes it still would have been kidnapping. If you hold some one even in the house like a boy friend or a girl friend it still is kidnapping no matter what. Also you would be charged with Criminal confindment. So you would actually be charged with more than just kidnapping. You would be charged with a whole bunch of differant crimes.

It was based on a story shown on either Dateline NBC, or 48 Hrs a few months back. I wish I could help you more, but the televsion program was probably better than the Hollywood version of what actually happened.
