How has the 8th Amendment helped us recently?

"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted"
How has it helped "us" recently ? I'm not sure it does... or I'm not sure that the legislative bodies or judiciary has an understanding of it.
Michigan has made adultery a first-class sexual felony :-? And yet our National legislators receive their pensions while in prison. And of course here in California, we can't seem to make the death penalty move along even though it HAS been ruled Constitutional
