I am a non-smoker and don't like the stink of cigarettes or the associated litter. However, what you do to your own body is your own business. Allowing smoking in your business or office is your business and if I don't come there due to smoking that's my business. The government and all the do-gooder, busy bodies need to get there noses out of a person's private affairs.

It isn't just smoking, that's one small segment. California is trying to outlaw spanking. Some states have outlawed certain foods because they are bad for you or a goose gets killed. Soon there is going to be a tax on being overweight. One day a cheeseburger is going to be illegal. Listen to the rhetoric, its the same as the anti smoking noise of 15 years ago.

People! We need to right now put our collective foot down and tell the government to get out of our private lives. Who is in charge here? You? The do-gooders that want to control your life or the government. It should be you and me in charge of ourselves.

I am not sure which is worse here, the subtext of the question or the answers it has received so far!
No matter how much someone dislikes something (like smoking), They do not have the right to impose their views on others. I can see the need for "No Smoking" in a workplace, because workers are in fact a captive audience, they cann not just leave!
But in a restaurant, customers have a choice- they do not have to go there! And no, you do not have a legal right to not be offended, your legal right is that if you are offended, you can leave!

I sort of agree with you on that point. On the other hand smoking not only causes cancer but emphysema and other smoking related problems, and it just outright stinks to high heaven. I'm an ex smoker and I will stand behind smokers rights to have their special place. I will also never support banning of smoking in private vehicles or in the home. The other side to that coin is, don't force the stink on me either.

yes, it is just a very, visible habit that the media and government can turn the general public toward while they cover up the real problems that should be taken care of. smoking is a very personal and mostly harmless habit to others that don't smoke. smokers should not throw their butts around as trash and should be courteous of smoking around others. but the big baddy is the legal system that thought up the class action suits. smokers and their families should not be aloud to sue if something happens to their health due to their habit that they know might have repercussions. i think that started all the problems for smokers...and i am one.

when new york city passed the smoking ban a few years back the mayor at the time, i'm not sure which one, had this party with all his rich friends, it was some function, maybe to raise money or something, anyway his buddies were smoking cigars, when asked about it he said he wasn't aware of it. the people that make these laws, aren't going to be effected by them, because they only apply to the voters, or non-voters.

Only if you're a smoker. The decades of evidence that smoke, even passive, increases your risk of cancer isn't good enough for you? For those of us who don't smoke, it's a welcome thing. Smoking is a PERSONAL lifestyle choice. If I haven't made it for myself, I don't want others making that choice for me.

And peanutbull, NYC just passed a law that trans fats are not to be allowed in any of the city's resaurants. Many people were actually very accpeting of that.

No smoking laws are not getting out of hand. Second hand smoke in public areas is what had gotten out of hand.
