I've not known it to be called harsh before, I can think of other words that may be more appropriate...... sometimes a helping hand may be the only way...

Yes - punishment should be decided by someone impartial who can look at the facts and give a non bias opinion on what punishment is suitable. If you are involved, your feelings are likely to come in to it, and that will affect your judgement.

Depends on the crime committed. If someone is raping your daughter in your home, shoot em.
If someone flips you off on the road, let is slide and do not allow it to affect you.

Depends on the context... disciplining a child is not necessarily harsh, but murder likely is.
