You're right, it shouldn't have to be up to the courts to decide.
Married adults should have more morals than to sleep with someone other than the spouse anyway.
Would you go to the police and tell them your spouse was having an affair?? I sure wouldn't, I'd take him first to the lawyers office and then I'd take him for all he's worth!!!

I think that your question is rather undocumented. There are few Muslim countries that support this kind of punishment, just like Michigan is for the entire Christian society. But, adultery is usually misinterpreted. For instance, in 18th century Turkey, a man could have had 7 wives and 8 mistresses, but he wasn't stoned to death. Actually this was a sign of power. For women, on the other hand, if they committed adultery, the punishment was even death by stoning (but not always, they were usually sent to prostitution, and just after several cumulative deeds they were killed). So, as you can see, adultery prosecution is mostly applied to female misconduct. In my opinion, the ethical laws that govern the entire society will always punish in one form or another people who commit adultery. But, I disagree with the criminal prosecution.

I would have to say yes to this question. After all if you look at it this way a woman or man finds that his or her spouse is cheating and if and when he or she does go through with the divorce it all goes to court and things as of this nature will come up such as.... why didn't you end the marriage, did you use protection, is it worth losing your children over, and not to mention your respect in all aspects. After all what if the person cheating was not using protections and brings a STD to the none cheating partner hell yeah he or she should up hold some kind of punishment! Oh and the government regulates you even in having sex so you might wanna keep in mind only the missionary position is legal as well. So yes the government owns us and well they run our lives but there is nothing that we can do. The way I look at it either partner would have you break there hearts by saying its over then breaking there hearts by finding out your cheating on them!! In the world today we all know that it happens but damn you can't have your cake and eat it too! And also sometimes after the cheating is over that one person realizes that the little "honey moon" stage is over and what they left for what they have now is not worth what they left. Then again this is just my opinion! :)

Yeah, and their Attorney General admitted having an affair recently. The judges were simply interpreting the laws of the state literally. As absurd as this sounds it will force the legislature or state supreme court to change this law.

Since this is not quite a question, more of a solicitation for opinions, I am going to offer on my 2 cents on the subject of adultery. What makes me ticklish on this subject is that if allowing divorces is the best way to avoid adultery, will the catholics permits it? I can just see them squirm for an answer now, lol.

Since when courts started deciding who we sleep with? Adultery is wrong..........but it's a personal issue and no one can tell you who to sleep with.
