You cannot sue Kaiser for malpractice. They are protected by ERISA! You signed a contract that you would have to go through arbitration. A dead end. You can sue them for corporate false advertising that they care for their patients and misleading people that they practice good medicine. Kaiser is an HMO. They are corrupt in Medical terms because they only take patients who can pay. They dump all the nonpayers onto the community hospitals. They also make more money in bonuses at year end if they can trick the patients into waiting a long time for their care, not order tests, or do as few procedures as they can get away with. This was helped along and supported by Hillary Clinton. The Doctors are sort of dupes for going along with this nastiness.

That is tricky. How many weeks pregnant were you? Were you 10 days past your due date? Did the doc do a non-stress test? Did they determine why the baby died?

Induction is usually only done if there is reasonable cause to believe that the baby is in distress. If the proper tests were performed and the baby was fine then they can't be held negligent. If you missed any appointments or failed to report any symptoms that you were having at the time (decreased fetal movement) it would be easy for the lawyers involved to shift blame to you.

I am very very sorry for your loss. You must feel so many mixed emotions. Have you sought counseling? It may be a step to helping you heal.

I would call a lawyer and ask for a free consultation. They could probably tell you if you have a case.

My heart goes out to you.

I'm sorry for your loss. 1st Get the medical records from Kaiser for mom and baby, if there are any, and consult someone you can trust in the legal or medical feilds.

You need to talk to a lawyer. Did you ask them to induce labor earlier?
