I am a consumer and I spoke up sharply and negatively about a company that is indeed ripping off others. My "review" circulated across the net... and in fact many agreed with me.

Three weeks ago I started receiving emails from their lawyer threatening legal action. Everytime they come across my article or statements on a blog or in a discussion (not on my sites), I get another "formal notice" email ("govern yourself accordingly").

It's to the point where I'm starting to think going to court might be the best option... sueing them for harassment. While I may have posted a negative review, I am a consumer and entitled to freedome of speech. I don't know why I'm in such a hot seat and I'm getting sick of it.

What's the worst I could face if sued? Possibly bankruptcy?

Does anyone know what my options are? How far could this go?

By the way, the company in question is operating a money scam... if taken to court, I think that company would be out of "business". Suggestions?

you are definitely entitled to freedom of speech and if they weren't involved in something shady they wouldn't be bothering you
anyway the customer is always right

there is a thin line btween libel and freedom of speech-err press in this case..
freedom of speech would be slander opposed to libel....

and almost anyone can sue..............esp a company that could possible put together a case showing damage to their "business"
as a result of what you printed....

consumer or not--libel is libel..and a company with a lawyer is indeed a dangerous beast....

you might consider mulling over speaking with an attorney and maybe even a retraction or milding down of your comments..?

I agree that you are entitled to your free speech. However, if you said something that could be considered slander or libel they may have legal recourse. Best advise call a few lawyers and see what they recommend you do...they may be able to point you in the right direction.

Are these guys actual businessmen or is there some kind of cover up? You are entitled to your opinion. I don't know how "negative" you were. What could they sue you for? Figure that out first. I think they are trying to scare you. I would call the Better Business Bureau ASAP!

A lot of it depends on what you said and how you said it. As long as what you said is factual, based on your own personal experience, you are free to relate that information to whom you wish, how you wish. If there is speculation, heresay, or anything that is not based in fact, you could be held for libel, slander, etc... They are most likely trying to scare you.

Technically, it go as far as their lawyers are willing to push it. Keep records of everything. If you have a lwyer friend, you ask him/her to write a letter back to them, telling them to cease and desist (sp?)....

first thing u have to do is apologize for reviewing negatively.posting reviews are not bad but it should not hurt and disturb them in any way.if u r very strong enough to fight with the company for its money scam then u can fight only with evidence to prove as u r a consumer.

there is nothing that they can do to you.... you are not lying about them, it is called freedom of speech. and plus it is only e-mails. is the "lawyer" even legit? and if it comes down to it block the address.
