My friend is married to a women who was formally an illegal imigrant. They had a child and now she is threatening to leave the country with there baby. He is way against this and putting up with alot of abuse to make sure she doesnt leave. What rights does she have to leave and what rights does he have to keep his child in the country with him? Basicly can she just up and leave the countrty with there baby and what can he do to insure this doesnt happen?

Are they married? Who has primary custody? Get a lawyer and file some type of injunction to prevent the mother from leaving the state until custody can be establised

I think perhaps a Lawyer would be better than yahoo but since you asked,

I would advis ethe authorities of her status , as the child and your friend are US citizens the child would stay here with the father, and the illegal will be sent home .

I would like to see someone fighting a custody battle from down Mexico way.

if he is the biological father, NO she cannot just up and run and yes it would be considered kidnapping. iwould get authorities involved right now, a lawyer, even tape her saying how she is going to steal the child and run away, it will be good evidence, or any evidence you can get would be best, because this all will im sure as a custody battle go to court one dayy, and the police need to know she is saying this in case she really tries at least they arnt starting from scratch. bleh good luk.

Travelling outside the US with a minor requires "travel permission" signed by the other parent if not present....even in Mexico.

If she is Mexican...

It is doubtful that a Mexican woman will be questioned as to the citizenship and status of her spouse. Even if she is occupied by a minor child.

BEST BET...see a lawyer MONDAY....not tuesday.

If the baby was born here, he is an American citizen. He needs a lawyer, not yahoo.

in case you do not love your husband adequate to stay committed. leave him and supplies you him custody of your children and then you will be able to stay you existence as you pick. Or unload your lover and artwork on your relationship such as your husband. you are able to't have both. in case you proceed both the entire existence will blow up on your face.

He needs to see an attorney RIGHT NOW, and don't tell her he is doing this. He needs to protect his rights and his child's welfare.
It will be much harder, maybe impossible, to get his child back if he waits until she actually does it.
