If you were both going to live forever and that person is who you would want to be with, forever, then get married.
When a person is going to leave this world is always pending, every moment.
Legally, inheritance issues, would be more specific per state, and if there is a question of that or if that has entered the decision, then you're not ready to marry. Also, you do no favor to anyone by marrying them for any less than a hope of forever and ever.

Yes it is legal. You can get the answer to your questions just by calling the Local Court House. Tell them you want to get married and would like to know the legalities of it the Marriage License and all. They will direct you from there. Bring pen and paper to phone before you call! Marriage is a contract. In order to have a valid contract the parties involved must not have any mental defects. This means that the parties involved should be of right mind and able to make their own decisions.

first why do you want to marry this dying person, whats in it for you. obviously you could have married before now.
besides that , maybe not , because now that person is sick and not in a good frame of mind .
nothing would stand true, family could always argue the fact.

As long as you're both legal to be married (adult, single, of sound mind) I don't see why one's health status would be a barrier. Of course, it might be grounds for challenging a marriage later if there's an issue of an inheritance.

BUT my guess is no you can't because the dying person has to indicate that he/she is willing to be married. It's after the wedding when people act like their dead or they don't know that they are married.

I do not believe so. In order for it to be a real marriage both of you have to agree to be married. I do not think any clergy or a judge will marry you if one of you is not aware that he is getting married.
