My husband and I are separated. I have both the kids. I don't stay in contact with him. Am I still required to file jointly? We have been together for a long time but were never married. We had problems and thought we could work them out, thought lack of commiment was one of them and got married. Now, he's gone and I have both kids still. Can I no longer file head of household? If I can't what am I supposed to do about getting him to come file with me?

if you are still married as of dec 31 2006, no matter what else, you either file together or married filling separated, if you have not spent one nite in the same house in 6 months, you can file head of household. if you did then you can't. this is of course federal law, state laws can be a lot different. you and he do have to discuss things even with that, because if you and he have to file the same way. talk to an accountant.

If your the main income for the children most of the year 2006 then you can file head of household. I would file alone and file for the children. Ask your tax guy and make sure you file before he does....just incase he claims the kids first_

No, you do not. Even if two people are happily married, they are not required to file together. You do because you will usually get more back, or have to pay less if you file jointly. Just file on your own.

You can file married but separate.. However it will cost you more in the long run and you will lose money.. It is better to file a joint tax return since you are still married.

It depends were u together a majority of the year or not.. if u were still living under the same room for half or more of the year..then u have to file jointly.. if u've been seperated most of the year u can file seperate...

You should be able to file separately. I would talk with a tax expert on this one to see how much of his stuff you need to file separately and to make sure that he doesn't claim the children. My next step would to divorce him so that you are free again.

No, you dont have to file jointly. File head of household. Dont forget to claim tax credits for paying childcare.

No file married and filing separately. get H&R Block or someone like to deal with it it is better in long run!

Maybe you've never realized before, you usually get a larger return fileing seperately. If he's good enough(trustworthy) you can rotate who claims the kids and when. If not, you have all the proof you need to show the kids are under your direct care and supervision.

You do not have to file joint returns, but I would check with a tax attorney to be sure. You can claim both kids as dependents. Any child support payments made by him are not tax-deduct able. Alimony is.

A tax attorney can make it as simple for you as possible.
