I have just started my new job on January 15, 2007. I am 13 weeks pregnant. I asked my current employer about preg. leave/medical leave. They don't seem to offer any leave until after you have been there 1 year. (All other benefits kick in after 3 mos.) And since I haven't been there one year, I can't receive leave from work nor can I use FMLA. They won't guarantee my job when I can come back. ( I also live in the state of Iowa.)

Any suggestions???

try taking leave under the short term disability benefits. If you go that route (which I did) You will get paid the max benefit for the six weeks after the baby that your doctor requires that you take off. You may have to work right up until you have the baby, but you will get six weeks off with partial pay.

Unfortunately, according to the fmla act, you are not eligible for it.

An “eligible” employee is an employee who has been employed by the employer for a least 12 months and worked at least 1,250 hours. The 12 months do not need to be consecutive. You are only an “eligible” employee if your employer employs 50 or more employees within 75 miles of the worksite.


Is your new employer nice? I would appeal to your boss and try to make provisions to stay at your new job. They may be able to work something out with you.

unfortunatly that is how it works, I left my job to take another position for another company, and came back 2 months later when I found out I was pregnant luckily they let me keep my seniority and I get my leave, but legally I shouldnt be able too. Hopefully they will have a spot for you, good luck.

Plan ahead. Save as much money as you can now while you are able to work so that when it is time to go back you have some cash to help you through a job loss if they don't take you back.

i would look further into the FMLA for your state to see what your employer can or cant do.
