My first instint is to say hell yes! And I think people who sue people are as scummy as the people they are suing.
My second thought is that you should consider her family situation. Does she have kids that will go hungry because you want to get even? If she doesn't have kids and you want to punish her then sue the hell out of the drunk. If she does have kids, then let the law do what it will and sue her for nothing more than what the accident has cost you.

??? she will already be in alot of crap for what she did...fines, repairs etc. If you were hurt you should sue the ins. comp. for your hospital bills. If you are ok. then drop it. she will have to deal with the company for the repairs. People who sue for false pain acusations is the reason why everyones insurance rates are so high now....
