then emptied it is there anyway I can get those files/pictures back?

You can recover them (if it hasn't been too long after you deleted them.) You need a software to do this, I recommend the software from http://www.recovermyfiles.com/

Look for a free download called "UNDELETE", if your system has not overwritten the file it will be recoverable.
It was quite awhile since I read about the program so I can't tell you anything more than the name of the program.

Not sure but a system restore might. I did one once and it put some files back that I had deleted. Not sure how to pick & choose though.

Yes, there are actually many file recovery programs, I do not know the names of any off the top of my head ... time to Google. Good luck.

You have to use disk recovery software such as Stellar Phoenix.
