The mother is a 16 year old who has no patience with the child who is only 5 months old.My son wasn't allowed to bring his son down for a visit to see me(his Grandmother)My son is at his wits end,I suggested that he go to legal aid first thing Monday morning TO FIND OUT WHAT HIS RIGHTS are.And if the welfare are going to say that because I have a Disability, that impairs to look after the child, then that is discrimination.Lots of issues that I can see here.Trish from Australia

In 2005, many states passed laws regarding "kinship caregivers" both in and outside of the child welfare system. Arizona, Arkansas, Maryland, Montana and Texas passed legislation promoting the use of relatives as foster caregivers. Maine, Maryland, Tennessee, Missouri, New Jersey, and Ohio established or amended existing guardianship initiatives. California, Colorado and New York imposed new requirements regarding searches for and identification of relatives who could serve as placement resources. Hawaii, New York and Washington expanded or clarified the authority of kinship caregivers to make decisions regarding a child's health care or education. Idaho enacted a new de facto custodianship law. Tennessee funded new services to elderly foster parents and disabled relative caregivers. Washington required an oversight committee to monitor kinship care recommendations and activities.

There are also a ton of websites on grandparents rights.

In these states you have to be given priority when it comes to guardianship over your grandchild. However, if the child is NOT in the custody of the state, you will need to report the current caregiver to the department of children and family services in the county/state they reside (assuming there is some type of abuse)

There is actually a legal precedent for this that works against your favor. It was made so that grandparents can't get custody of grandchildren if the parents are willing and able to take care of the child on their own. Unless something happens to them so that they lose custody of the child you won't get 'em. The only reason I know this is because my grandparents filed for custody of my brother and I when we were young but weren't granted because my parents weren't in any legal trouble or anything, and were providing for us just fine. If there is a problem that the child isn't being taken care of you should report them to Children's Services, and after looking into it they'll probably grant you custody if the parent(s) are deemed unfit.

Find a family law attorney, find out what rights fathers have. Also ask what is needed to prove the mother isn't the best parent for the child to live with. Ask what to do to proceed for visitation/custody.

If the parent(s) are unfit and/or the child is being abused or neglected you should contact the Child Protection division in your state. There is an abuse and neglect hotline that you can call to report these types of matters. If they are found to be unfit or abuseive then the state and the family court will get involved and look for relatives for placement of the child.

there is such a thing called grandparent's right. not only do fathers have the right to see the children grandparents do to you both can go to a lawyer or solicitor and ask about your rights you are both able to have the child over night and on every second weekend.of course it would be looked into as to why the girl wont allow you to see him, but if everything s ok then you wont have a problem in getting to see your grandson......

You have to get a lawyer (who specializes in custoday cases) and petition the courts for custody. Depending on who you are going up against (mother or father or both) it may not be easy.

If you get a good lawyer meaing the best you can afford you can maybe win. you have ot pay lots for him and he will work for you. they are there but its generally one that is going after them. I have seen them mothers my son had a mean girl but shes now put in her place she was 16 and married hima nd then slept with all anyhow fight.

Hire an attorney. You need to prove that your son and the baby's mother are unfit....it does depend on the state you live in...
