I had a friend living with me for about a year now. When she moved in she was told she had to pay my mom $30 a month. She never paid that and I was stupid to convince my mom to just let her stay. I also loaned her $250 along the way. Which she has yet to pay back.
A couple of months ago she went into rehab and left all her stuff here at my house. Well my family moved and a lot of her stuff is jammed into a room that you cant even walk into. I have a few of her DVD's and her Subs in my car. She is demanding that stuff back and is refusing to pay me. She is saying that she has paid me back in gas money and food. We shared the food we both bought and I carted her around in my car for about 7 months since she didnt have a license anymore.
She is threating me with cops and everything. I have told her I would give her her stuff when I get my money. How should I go about getting my money, and handeling her.

First, there is nothing the cops can do...if her name is not on the deed of the house, then nothing in that house "belongs" to her.
Second, she may try small claims court, but who cares.
Third, chalk it up to experience and let it go. Unless this girl cleans up her act and sees the error of her ways, you're never gonna see that money.
You helped a friend in her time of need...let it go.

If it had been £20 I would say you got rid of a problem pretty cheap. However, seeing that the lad owes you £500, well that is rather substantial. Using the court system is out of the question because you risk exposing you and him. That will not get you your money. Use of violence, even public violence would be useless as it might land you in the Bailey rather than in the money. I saw a movie once where a guy subtly ran a campaign called "Operation Gaslight". Fly pheromone was a good icebreaker. The hapless victim had it sprayed it in his auto and on his clothes. He was hounded by sex-starved flies for awhhile. The hormone also smelled rancid so it got him wondering what's going on. The hapless victim's motorbike had a nail mysteriously flatten its tire. The next day when he wasnt home, he found some day old crab or other seafood rotting behind a flower bed. Then a late nite telephone call, from a number that does not register. Then he discovers his home is invaded by roaches. Then some of his friends meet with him and casually mention he owed some money but couldnt tell him how they found out about it. The end of the movie was rather bad. The hapless victim lashed out at his creditor, Im afraid, with a shotgun.

Does she have proof that she left her items in your home? If not, it's her word against yours. Gas money and food were not part of the loan repayment agreement and would not hold up in a court. You can take her to small claims and could possibly win, especially if you have any agreement at all in writing that she signed.

She and you can never reach an agreement by yourselves, it seems. The only answer is Small Claims Court.
Make sure that you are not holding her items if she does not owe YOU the money. She might owe your parents the money, but not you. Have all your receipts documented so that you can show them to the judge, when he asks for them.
Do not add irrelevant information while you and your parents are on the witness stand.

I understand the desire to hold onto her things...however that isn't legal. What you need to do is let her get her things, make her sign something stating that she has received all of her property back and then take her to small claims court for what she owes you. Honestly though for that amount of money I think I'd just drop it so as to be rid of her and then chalk the experience up as a lesson learned.

You didn't make an agreement to compensate gas and food for rent. You now need to go to Landlord/ Tenant court because by law you can't throw out her stuff. And Your mother was her landlord so she has to pursue this. You need to ask how to sue for your money or charge it to the game because if she's in rehab you should't have expected your money back when you gave it to her.

The police will not get involved. She will waste their time and they will inform her and you over your legal rights and all of you will be on your way to civil court. Maybe you have a good episode for Judge Judy, Judge Hatcher or any other T.V. Judge that offers to resolve cases like yours .

you are going to have to file a complaint in Civil or Small Claims Court..

more than likely, the judgement will end in you only having to return her belongings after she has paid her debts in full...be sure that when you file, you seek compensation from her for court costs also...

I would get this done as soon as possible...

Take her to court. Honestly if this was the government they would take her stuff too. And not give it back until she paid. try to make sure you have proof that she owes you if you just so happen to go to court.
