Your issues lie far larger than the damage. Yes the towing company is liable for damage they cause, but can you prove they were not there before? That's the problem. If you can by eye witness prove time of disablement to towing and pre-tow condition you have a great court case that will yeild you well. If not your out of luck my friend. I know you did not want to hear that, but I have operated a towing service along with my repair shop for 18 years and thats just the way it is. Good Luck.

yes get an attorney if you have to.what the tow truck driver did wastry to sling it and did not do it properly.when the police had it towed the should have filled out a damage report before it was hooked by the truck and either they have it or the impound lot does.get a copy to show there was no damage before it was picked up.somebody has it dont take no for an answer

I think what you're asking is, can I force them to pay for the damages? I doubt any lawyer would take your case, since they work on a contigency basis, and the cost of tracking this down would be more than they can make. At best, you would get what, $1000? Your lawyer would get $333.
Another option would be small claims court. Or Judge Judy. Or make an insurance claim (if you had full coverage) and let the insurance company track them down.
The only way to really get any money out of it is to get a judge to agree with you and order them to pay.

After having many of my own cars towed....if it gets impounded the police will fill out a form on the vechiles overall condition and contents and that is then giving to the driver to sign off on as he agrees...you have to find the form the cops should have filled out....but still your word against theirs'

If the car was damaged while it was being towed then I'd say yes they are. I would be very upset. Your car should not get any damage from being towed. I would talk to a lawyer or possibly another police station.

yes they are liable for any damages they cause from towing one ,or picking it up,,once their in possession of it,,there responsible for it,,until you get it back,or if its setting on their storage lot their also liable for it,,you,ll need to talk to them on this matter, someone is liable for the damage to it,,good luck i hope this help,s.

no there is no proof that the wrecker driver did it, these days it could have happened to the car before the wrecker got there. just your word against his. no case there.

yes they are liable, They broke my steering wheel, they paid for it, but it was like a $70 dollar steering wheel, you might have to prove it.
