It is unconstitutional. But when has that ever stopped bush from doing anything that he wanted.

A constitutional amendment could be passed. An amendment becomes part of the constitution itself, rendering it immune from court challenges.
I saw on the original question that you don't believe any Congressman would ever introduce such an amendment, and at this time, I agree. Let's discuss the situation again in a few years time, assuming the ever-so-peaceful Muslims have not ceased acting like the animals they are.

The U.S. Constitution obviates any system of totalitarianism.
Islam, like Communism, Fascism, and Nazism, is a totalitarian, autocratic, intolerant, and undemocratic political philosophy of theocracy.
Therefore, Islam is incompatible with our Constitutional democratic principles and should be banned from the public square/sphere, according to the same concept that the ACLU employs to ban Christianity from the public square/sphere.
Of course, this will not happen. That is, until we as a society suffer more attacks and wake/wise up--hopefully before it is too late.
Deport all illegal aliens and Islamists.

The structure of the US guarentees in the first change the right to freely workout faith. "Congress shall make no regulation respecting an institution of religion, or prohibiting the loose workout thereof;" So any such regulation does no longer be Constitutional in the US. in reality, i'd guess that the great court docket does no longer even listen the case as your regulation banning Islam might want to be wisely overturned at a decrease aspect in the judicial branch. Rick N. I guarentee your Constitutional change might want to in no way bypass in the US. you would possibly want to be fortunate to rigidity a Senator or Congressman to even carry the challenge up.

There is no such thing as a stupid questions. A question full of hatred and ignorance yes, but not stupid.
Everything is possible when it comes to politics. Even if we do have freedom of religion there is always a way to bend and twist things to get what you want.
I would not dought that someone would try to ban Islam. For such a free country you see people trying to take away freedom from those they disagree with.

The Asker made the question too tough by requiring the Answerer to cite case law or references to the Constitution. :)

No. Violation of the 1st. We can restrict only time, place and manner of speech. And as narrow as possible to achieve some compelling state need.
I'm fairly satisfied that radical Islam can easily be quelled under the Constitution, which is really the issue.

Why not? We're already well on the way to banning mention of Jesus anywhere in public view. Military preachers have been told not to mention Jesus when preaching. And Congress is considering severe limitations on lobbying of religious organizations....
