If it was policy, if it was ordered, if it was known about and was allowed to happen.
If individuals did it on their own, in violation of orders, without the knowldge of the commanders, it is only the fault of the individuals, though some charges of negligence will fall upon their immediate commanders.

if the daughter of a successful Hollywood actor abused her right to citizenship and had humiliating pictures of herself taken at enemy gun emplacements during wartime,should she be allowed back into America without being charged with aiding and abetting the enemy and tried for treason?

its a violation of Geneva convention. good thing bush calls them battlefield detainees or whatever and not POWs or he could go to jail .
