The ideal notion behind the concept of laws is that they will be followed without question and no government enforcement will be necessary. So, ethically, yes the government can pass laws it can't really enforce.
However, if the law is a violation of personal freedom (like the outdated laws prohibiting, for example, intercourse in any position other than missionary) and it's impossible to enforce, there's no reason to waste time or money passing the law in the first place.

That would be preferable to the government taking actions that do not fall within any law or permits the government to be exempt from law.
There is far less harm to society in laws passed that cannot be enforced.

There are no laws that the USA cannot enforce unless they CHOOSE not to enforce them....ethically (which we all know is never considered in congress) all of our laws should be enforced!

Yes. Provided it is a law for the betterment of society. There are many Americans that would not do the "illegal deed" simply because it is illegal. Again, provided it is for the betterment of society- better stop those law abiding citizens than to not stop anyone.

No, but they do. Today I was reading were adultery is punishable by life in prison in some state. Do you really believe that will ever be enforced?
