I think it's retarded, for God's sake it is an American flag! However, if he is in violation of zoning codes and did not get the required permits, then that town has every right to fine him. Legal technicalities are baffling...

First of all ........... I think he is in dire need of a new hairdo. Ok, as for the fine, on one hand, the height of his flagpole goes against the town ordinances. I can see them having a limit on that. I wouldn't want my next door neighbor having a 50 ft flag pole with a 10 foot flag waving either. I love my country but ........ On the other hand, it's the AMERICAN FLAG for cryin' out loud! So with the two sides stated, I have to go with position number 2. I hope he takes it to court. It's ridiculous because it's on a huge building anyway. And I'm sure he's right. They just pick and choose which ordinances they want to enforce.
