sounds like a similar problem to what I had on one of my windows late last year.
i checked on my other windows and they all had a small black wedge shaped block that the handle rode up onto when the window closed, the window that was draughty had these blocks missing.
I went to my local hardware store and he informed me that this was a common occurence and he was able to provide me with a set of new window closing cams(his name not mine) and he also suggested that i glued them in place. this cured the problem and i have since gone round and checked and refixed these blocks on all of my windows.

Why do you need to take out the glass? if they're not closing tight could be because of a few reasons. If it's not closing tight on the hinge side then you may need to replace the hinges , if the draught is coming all around you could replace the gasket/ q-lon that is in the frame. If the gap is just on the the opening side ( the same side as the handle) if you look at the lock , the cams ( the mechanism that locks the window) you will normally see a hexagonal shape within the lock / cam, if you turn that with an allen key you will see it moves in and out , making the window shut tighter / looser , depending on which way you turn the key.

We had our panes replaced recently. The chap cut out the old glass panels from the outside with a Stanley blade and replaced with new ones. Unfortunately I did not see him do it. But he was very quick and made us feel quite vulnerable! Can't help with the other points but there are people that repair and replace parts. Much cheaper than a complete renew.

There's probably something blocking the windows to open. Try to move it back down then up again and if that doesn't work then you can probably call on experts to check it out.

You might be able to get that information from HomeDepot, Lowes, or other home improvement centers, hardware stores, or places where they sell such windows. If you know the manufacturer contact them. Look on-line for how-to sites. What exactly is causing the problem,or how exactly are they closing?

Dont bother - get on to your Lawyer - and see if he/she can claim anything back from the seller...or the Surveyor... if that doesnt help ...wait a couple of weeks - and claim your buildings insurance ....after all there is a lot of bad weather going about at the moment - blame it on that..the insurance company wont even bat an eyelid...you dont get if you dont ask & your too honest...
