If the posts are on your side of the boundary the responsibility for repair is yours, if the other side then it is your neighbours. Beware that fences and hedges can cause friction between neighbours. Suggest you discuss a joint repair with the neighbours.

If you are quite sure that it's their fence (one way of checking is to see on whose side the boundary posts come), then you must be firm with them. They may well not be in a position to replace the fence and this is probably the worst possible time to try, with all this snow around. However, while waiting for something better, they should at least be prepared to patch it together, as it is at the moment constituting a trespass on your land. It's no good waiting for them to take the initiative: they are probably dreading having to meet the cost of a new fence and are putting off the evil hour. Knock at their front door and have a civil word with them. It's far better than taking legal action at the County Court. Quote Robert Frost at them: "Good fences make good neighbours". But be firm: you will have to take action if nothing is done soon.

lol
well after just having my first house i looked into this as one side of my garden has a horrible looking fence the other side looks a dream
i found out that i was responsible for the fence on the right and my next door neighbour on the left is responsible for the horrible looking fence
oh well thats the uk law

If it is a property line fence and you are on speaking terms, then you should offer to split the cost with them. Otherwise, its however you can sort it out. Small claims court should be a last resort.
