The evidence was given to someone outside of the dept. "a family member" for seven months, for their own personal use.??

It depends on the department. There are usually reasons that evidence would be removed from the evidence room during a police investigation, like testing the evidence and examining the evidence.

If the item was found to have no evidentary value, they can return the item to the family. If the item has high evidentary value, and the item is given to a family member, then that does violate protocol in most areas.
