I know a young mom who wrote a check to Walmart because she expected certain funds to be deposited before they cashed the check. The funds were late arriving, so her check was returned for insufficient funds. The other store she went to, Mervyns, re-cashed the check she wrote there and it went through. Wal-mart didn't even try to re-cash the check, filed a criminal charge, and now the lady has to pay double, attend a Saturday morning class (and she has four children-same father-without weekend childcare), and her husband is out of work due to having been accused of a crime he didn't commit, and has been removed from the home by CPS rules. This is the first time she has had this problem. She won't have the amount the DA wants until after the first of the month...which is after her deadline.

.... the situation all seems a bit to extreme to be real to start ....
but companies are allowed to charge a fee of what ever the bank will charge for overdrafts ... they can also file criminal charges ... but they should've rant he check another time .... i do an online business and my money is handled thru paypal and they make 2 attempts after that its up to me to decied what to do ... i understand how it feels to write a check and the funds you expect show up late ... the DA seems like an as$ .
maybe she could find a depenable highschool student who wants to make a few dollars to watch the kids ... or maybe a friend who would be willing to helpwatch them .

She should be able to work something out with the DA, if not, she is the one who wrote a bad check: it's just the way it is.

I guess the lesson is not to write checks until the funds have been deposited.

Tell you what, next time she needs to write a hot check you cash it for her.

This same scenario happened to my friend. She paid the fine and took the class, and it wasn't that bad. Once this is past you, I don't even think it'll be on your record.

From what your saying about this disfunctional bunch they have nothing to complain about. Its their own actions and actions getting them into this situation that are the cause. ANd this "accused of a crime he didn't commit" come one.

I have never heard of a couple bounced checks getting such retaliation. There may be more to the story that you don't know.

I think she AND the person who wrote her a check should both be in jail for 6 months. You don't spend money you don't have. Period. Even if you THINK you will have the money, DON'T SPEND IT.

Don't count your chickens before they hatch.
