Ethically, you're leaning the right way. But realistically, consider the situation. Is there a chance the current employer could EVER find out about the consulting? Is there a chance your old boss would EVER want to purposely get you in trouble and rat you out? Will the consulting require you to take time off of your current job? Another big thing to consider is do you have others depending on your income? A family? If so, I'd probably not do it. Wouldn't you feel awful if a decision like this cost those you care for? On the other hand, if you're single, ehh, go for it.

These are the things I would consider, and if everything seemed safe, I'd go for it.
