Hi Bug Eyes, I got my yorkshire terrier when I was 12 years old. When I was 17 I moved in with my boyfriend & took my dog with me. Then in 2010, after almost 6 years together we broke up and he tried to take MY dog. Luckily, I have a brother, a dad & a lot of uncles so we never needed to go to court ;) but I know I would have won because she is mine. I'm not sure why Bloo is now in his possesion when you both got him as a couple, and for free but I'm almost certain you'd be wasting your time and money in court if he's with your ex right now. I think your only real chance of getting Bloo back is to pay your ex a visit and talk it out. If he's anything like mine (and to be honest, he sounds like it) then you're going to hate this I know, but just grit your teeth and bear it. You should talk to him about Bloo's welfare - explain that he needs, and will need regular vetenary care for the rest of his life. Dogs don't come cheap and he just can't afford to take care of him properly. Tell him that if he really cared about Bloo, he'd hand him over. You might have flash the cash but, it's a small price to pay to get your dog back where he belongs! If he still refuses, I would pay a visit to animal welfare (I'm in the UK so I don't know what that is in your country) but if you tell them your ex has a dog that has been left without vetinary treatment, they have to investigate. With what you said about the surgery, they'll see your right & they should be prepared to take Bloo away. If your ex has any sense, he'll hand Bloo over to you before an authority have to get involved. If all else fails, play dirty. You should threaten him. Tell him you have a recording of him selling drugs, tell him you'll go to the police and report him, let him know you mean business. People might disagree with me on this point, but if you love your dog and he's being neglected, you'll do what you have to get him back! Yea actually you can, I had a friend that broke up with her fiance and they actually went to court to set up a custody agreement for the dog! Visitation and placement!

Yes you can. I have actually had clients whose divorce settlements involved the care and custody of dogs and cats.

You can sue someone if the darn dog barks.....you can sue for any reason imaginable.

If you are an american living in USA you can sue anyone for anything !!!

I think you can in small claims court. Dogs are considered as property.
